Scott Gries, Getty Images Former Korn drummer David Silveria had a change of mind in his DUI case, deciding to plead guilty this week in exchange for a lesser charge. The musician was arrested last March for driving under the influence and committing a hit-and-run, but he claimed that extenuating circumstances were at play in making him seem as though he was driving under the influence. Silveria was pulled over by police on the morning of March 25 in Huntington Beach, Calif., but stated that he had not been drinking and blamed his driving woes on the after effects of a sleeping pill. The rocker claimed to have blown a 0.0 on the breathalyzer at the time he was pulled over, but the officers arrested him when he revealed he had taken a sleeping pill the night before. The drummer said he suffered from insomnia and did not realize the following morning that he was too exhausted to drive when he got behind the wheel. As he was heading to breakfast, Silveria reportedly rear-ended another vehicle. “It was an honest mistake,” said the drummer. In August, Silveria entered a “not guilty” plea , but according to TMZ , the musician changed his plea after the hit and run charge was dropped. As part of his punishment, the drummer was sentenced to three years of informal probation, and he must partake in a three-month first offender program and attend a M.A.D.D. victim impact panel. After leaving Korn, Silveria returned to music last year with the new band INFINIKA. Anna Weber / Carlos Muina / Karl Walter, Getty Images There were some eyebrows raised last year when Mastodon ‘s Troy Sanders and Soulfly ‘s Max Cavalera revealed they were working on a project together , and the anticipation level grew once it was revealed that Dillinger Escape Plan frontman Greg Puciato and The Mars Volta ‘s former drummer Dave Elitch were involved as well. With some time for the band to work through the specifics, Puciato has offered an update on their new album progress. He tells Noisecreep , “We have 11 songs written … We had a really easy time writing and we may actually be recording really soon, like in the next month or so. And then we’ll have to sit on it. We can’t release it right behind the Dillinger record and we also have to figure out when the Mastodon record is coming out and the same for whatever Max is doing next. It’s going to come out. It’s just going to be a matter of logistics as to when.” Puciato says the idea for the band came together when he was at a Deftones show in Los Angeles and started talking with Cavalera about their shared love for old thrash metal, punk and hardcore. He recalls, “We found ourselves referencing many of the same things and we were like, ‘F– man, we should make a record and do it together as a one-off like Nailbomb.” The Dillinger leader adds, “No one in metal makes collaborative records like people in jazz and hip-hop do. It doesn’t have to be like a band that you’re launching from the ground that you go on tour with. The iconic artwork has been replicated many times over the years, and Olympic swimmer Ryan Lochte is the latest to pay tribute, recreating the image for ‘ESPN The Magazine’s new music issue. The magazine has turned their focus to sports loving musicians for their latest issue, with Pearl Jam ‘s Jeff Ament recently sharing his basketball past in a piece that turned up prior to the issue’s release. Incidentally, the image of Lochte swimming with the almighty dollar in front of him seems apt as since his Olympic victories the commercial opportunities have opened up. He recently signed on to star in the reality series , ‘What Would Ryan Lochte Do?’ The ‘ESPN The Magazine’ music issue hit newsstands today (Feb. 8). Tool Dissectional Tool are one of the most critically praised and fan-worshipped bands in the world. The experimental quartet are musically complex, influential and incredibly original with both their music and videos. To celebrate the band (and probably to encourage them to finish their fifth studio album), some of today’s finest musicians, such as Tom Morello and Rob Trujillo , have praised the Los Angeles manipulators of sound. In an Artist Direct original column, Rage Against the Machine guitarist Tom Morello recalls witnessing Tool’s very first show “There was a band called Green Jello, who later changed its name to Green Jelly, and Danny Carey was the drummer,” tells Morello. “Maynard sometimes worked with them and lived in this loft where a lot of musicians lived in Los Angeles. Tool actually had their first show in that loft! A couple of the other guys from Rage Against the Machine were at the gig too, when we had just started writing songs. Maynard had been my roommate for a while, and I had grown up with Adam. I’ll be frank. We did not have the highest expectations for what was going to occur at that loft gig and we went kind of as “friend rock” [Laughs]. They were devastatingly awesome from the very first show though. There’s no other way to say it. They were just awesome. It was unbelievable.” Metallica bassist Rob Trujillo is a huge Tool fan, and so does his son. “My little boy loves Tool!,” states Trujillo. “When I take him to school, we’re playing Tool all the time, so I definitely connect with them. There’s a lot of bass in that group, which is nice. They’re a great band for a bass player to listen to. So believe it or not, my son and I are going through a big Tool phase! It includes every record too.” Gojira frontman Joe Duplantier credits Tool for creating his favorite album and getting him addicted to it in his sleep! “’10,000 Days’ is my favorite record, raves the frontman. “The first time I heard it, I didn’t get it. I forced myself to listen to it two times in a row. Then, I fell asleep with the album repeating, and I spent the whole night with the album in my ears. Maybe that’s why I got addicted! I heard it six or seven times in one night. It got to my brain very deeply. Liz Ramanand, Loudwire Finnish metalers Turisas gave the East Coast quite a treat by bringing their fighting spirit to Gramercy Theater on Wednesday night with help from Firewind and Stolen Babies. Turisas graced the stage with their signature red and black face paint and Viking styled clothing. Their New York militia gave them a very warm welcome as the band aptly kicked off their set with ‘The March of the Varangian Guard.’ They also played ‘To Holmgard and Beyond,’ ‘A Portage to the Unknown’ and asked fans to raise their beers to their drinking song ‘One More.’ Frontman and warlord Mathias Nygard had complete command of the stage while performing, as he looked his legion of fans eye to eye. Even though many of the members are fairly new, excluding guitarist Jussi Wickstrom, the band as a whole seemed to have great communication and energy onstage. Turisas ended the night with ‘Stand Up and Fight,’ ‘Sahti-Waari’ and of course ‘Battle Metal.’ which made their fans a very pleased bunch of mercenaries. Greek metal band Firewind took the stage and delivered some powerful vocals with new singer Kelly Sundown Carpenter. Guitarist Gus G. pulled out some blistering riffs as usual and the band as a whole had great stage presence while performing tracks such as ‘Wall of Sound,’ ‘Head Up High,’ ‘Mercenary Man’ and ‘Falling to Pieces,’ among others.
